Foley Hoag LLP is pleased to announce that Erin Estey Hertzog has joined the Washington, D.C. office as a partner in the Healthcare practice from the U.S. Department of Health & Human Services (HHS) Office of the General Counsel (OGC) where she was the lead attorney for the Center for Medicare and Medicaid Innovation. Hertzog’s practice will focus on advising clients on innovative payment methodologies and delivery systems, and she will build on Foley Hoag’s long standing practice of guiding life sciences new technologies through complex reimbursement pathways.
“Erin has over a decade of experience with complex healthcare regulatory matters involving public health programs such as Medicare, Medicaid, and the Affordable Care Act,” said Thomas Barker, partner and co-chair of Foley Hoag’s Healthcare practice. “The knowledge from her recent tenure at HHS will greatly aid our healthcare and life sciences clients as they encounter challenging value-based payment systems. We welcome Erin to the firm.”
Hertzog has considerable knowledge of system delivery reform and value-based payment models, having worked on dozens of the Innovation Center’s innovative payment and service-delivery models involving commercial payers, state Medicaid programs and leading providers. She has extensive experience in drafting value-based arrangements that will be critical to commercializing future novel technologies.

Prior to joining HHS, Hertzog served as the Director of Health Law and Policy at the Biotechnology Industry Organization (BIO), where she worked with member companies from across the biotechnology industry to craft the industry’s response to legislative and regulatory proposals on Medicare and Medicaid coverage and payment, alternative payment models, and government price reporting programs.
Hertzog earned her Bachelor of Arts from Colby College, Master of Public Health in Health Policy from The George Washington University, and Juris Doctorate from The George Washington University Law School.
